A COMPARATIVE STUDY BETWEEN THE CUSTOMARY INHERITANCE LEGAL SYSTEM OF THE COMMUNITY AND THE ISLAMIC INHERITANCE LEGAL SYSTEM ON INHERITANCE DISTRIBUTION IN MUKOMUKO CITY DISTRICT OF MUKOMUKO REGENCY

The writing of this research aims to: (1) understand and explain the inheritance distribution system according to customary law Mukomuko community; (2) Islamic law; (3) understand, study, compare between community legal on distribution. This used a normative method with comparative approach. A approach is an investigate similarities differences in things, people, work procedures, ideas, critics towards other groups, people’s perspectives group, country, or event. revealed that: clan law, either high heirloom property (known as Harta Pusaka Tinggi) matrimonial property, subjected matrilineal principles (the right daughters are greater than sons); Qur’an patrilineal sons daughters); comparison have some differences. Both systems tangent points which individual-collective under while individual-bilateral principles. Keywords: community, law.
